Article 1:
All purchasers are considered to be fully aware, without restriction, of the conditions of sale set out below and that by acquiring an object they establish their acceptance of these conditions.
Article 2:
Sales are for cash only with a supplement of 20% for costs plus royalties where applicable. In addition, each lot is subject to a closing fee of 1 €.
Article 3:
The description displayed on the objects for auction or shown in the catalogue should be taken as an indication only. It is the responsibility of purchasers to ascertain for themselves in advance the nature and condition of objects for auction by inspection at the exhibition.
Article 4:
No claims will be entered into after the sale, even where the description in the catalogue forms the object of the claim.
Article 5:
Ownership of the objects sold will be transferred at the moment of sale.
Between sale and delivery, “Hôtel de Ventes Horta” will retain the goods and assure their safekeeping.
Article 6:
In the event of any dispute or error during auctioning of an object, it will be offered for auction a second time. The presiding bailiff will adjudicate on any dispute arising during the bidding.
Article 7:
Purchasers must collect goods bought on Wednesday from 2pm to 5:30 pm or on Thursday or Friday from 10 am to 5:30 pm directly following the session. After these three days “’Hôtel de Ventes Horta” will not be liable for any claim of whatever kind. “Hôtel de Ventes Horta” reserves the right to reoffer for sale the lots in question at a later session, this to be at the risk of the defaulting purchaser and without notice being given.
Article 8:
All purchasers will be considered to have acted for their own account and will be personally liable for lots which they are authorized to acquire for another party. Lots must be paid for in Euro or by guaranteed cheque before they leave the premises.
Where payment is made by a cheque which is not supported by an acceptable form of guarantee, the goods may be withheld until the cheque has cleared.
Article 9:
In the event of dispute the courts of Brussels will have exclusive jurisdiction.
Article 10:
All sales to EU residents are considered to be made to private individuals, and VAT is therefore payable.
All goods must be collected from our premises and all costs of packing and transportation are for the account of the purchaser.
